Terms of Service

1. About these Terms

These Terms of Service govern access to and use of the CheckDNC website, application, APIs, data-processing tools, reports, credits, and related services collectively referred to as the “Service.”

CheckDNC is a software product owned and operated by NEBS-IT SOLUTION LTD, a company registered in England and Wales (“CheckDNC,” “we,” “us,” or “our”).

By creating an account, purchasing credits or a subscription, accessing the Service, or using any CheckDNC feature, you agree to these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

CheckDNC is a business-to-business compliance-screening software platform. It enables authorised business users to submit telephone-number records and compare them against supported do-not-call, suppression, risk, or compliance-related datasets.

Depending on the selected package, the Service may provide:

  • File-based telephone-number screening;
  • Record formatting and validation;
  • Results showing possible matches against supported datasets;
  • Downloadable screening reports;
  • Processing histories and audit-related information; and
  • API access or integrations where available.

CheckDNC does not place calls, send messages, operate marketing campaigns, sell telephone-number lists, supply leads, or provide legal advice.

Screening results are informational compliance-support outputs. They do not constitute legal advice or guarantee that any proposed communication is lawful.

3. Business use

The Service is intended for legitimate business use. You represent that:

  • You have the authority to enter into these Terms;
  • Your account and business information are accurate;
  • You will use the Service only for lawful purposes; and
  • You have obtained all permissions, notices, consents, or other lawful bases required to process the information you submit.

You remain responsible for determining whether you may lawfully contact any person, regardless of the result returned by the Service.

4. Customer data and lawful authority

You must not upload, submit, or process personal data unless you have the legal right and lawful basis to do so.

By submitting data, you confirm that:

  • You obtained it lawfully;
  • Its use does not violate privacy, marketing, telecommunications, consumer-protection, or data-protection laws;
  • You have provided any required privacy notices;
  • You will honour applicable consent withdrawals and opt-out requests; and
  • You will not use CheckDNC results to override or disregard a person’s request not to be contacted.

You retain responsibility for the source, legality, accuracy, and use of submitted data.

5. Prohibited uses

You must not use the Service:

  • For unlawful, fraudulent, deceptive, abusive, or harmful activity;
  • To contact people without the consent or lawful authority required by applicable law;
  • To evade do-not-call, suppression, consent, or opt-out requirements;
  • To identify individuals for harassment, intimidation, discrimination, or exploitation;
  • To upload stolen, scraped, unlawfully purchased, or improperly obtained data;
  • To facilitate spam, unlawful telemarketing, robocalling, or mass messaging;
  • To violate the TCPA, TSR, GDPR, UK GDPR, PECR, or another applicable law;
  • To gain unauthorised access to another person’s systems or data;
  • To reverse engineer, probe, overload, damage, or disrupt the Service;
  • To resell, sublicense, reproduce, or commercially redistribute the Service or its datasets without written authorisation;
  • To misrepresent CheckDNC results as legal advice or regulatory approval; or
  • To use the Service in a manner that violates Paddle’s Acceptable Use Policy.

We may suspend or terminate access when we reasonably believe the Service is being used unlawfully or in violation of these Terms.

6. Screening results and limitations

Do-not-call and compliance requirements may vary by jurisdiction and may change over time. External datasets may contain delays, errors, omissions, or incomplete records.

CheckDNC does not warrant that:

  • Every applicable registry or restriction is included;
  • Every dataset is complete or continuously available;
  • Every result is error-free;
  • A number marked as clear may lawfully be contacted;
  • Using the Service alone satisfies all legal requirements; or
  • Use of the Service will prevent complaints, investigations, penalties, or legal claims.

Customers should maintain appropriate internal compliance procedures and obtain qualified legal advice where necessary.

7. Accounts and security

You are responsible for:

  • Maintaining accurate account information;
  • Protecting your login credentials and API keys;
  • Restricting account access to authorised users;
  • Activities performed through your account; and
  • Informing us promptly of suspected unauthorised access.

You must not share credentials with unauthorised persons or attempt to access another customer’s account.

8. Credits, pricing, and service access

Available packages, credit quantities, prices, and features are displayed on the CheckDNC website or within the application.

Unless the applicable offer states otherwise:

  • Credits are consumed when eligible records are processed;
  • Credit usage may vary based on the selected processing operation;
  • Purchasing credits does not transfer ownership of the Service or underlying datasets;
  • Promotional or free credits have no monetary value;
  • Prices may be changed for future purchases; and
  • Existing purchases will not be repriced retroactively.

Any expiration period or usage limit must be displayed clearly before purchase.

9. Paddle payments

Our order process is conducted by our authorised online reseller, Paddle.com. Paddle is the Merchant of Record for purchases completed through Paddle.

Paddle processes payments, applicable taxes, invoices, billing-related customer support, returns, and refunds. Purchases made through Paddle are also governed by Paddle’s applicable Buyer Terms and Refund Policy.

We do not directly collect or store complete payment-card details for transactions processed by Paddle.

10. Refunds

Customers may request a full refund within 14 calendar days of the relevant purchase or subscription payment.

Refund requests are administered in accordance with our published Refund Policy and Paddle’s applicable policies. Our Refund Policy is available at:

Nothing in these Terms limits mandatory consumer rights.

11. Intellectual property

The Service, software, design, branding, interfaces, documentation, reports, and related materials are owned by or licensed to NEBS-IT SOLUTION LTD and are protected by applicable intellectual-property laws.

We grant customers a limited, non-exclusive, non-transferable, revocable right to use the Service for authorised internal business purposes, subject to these Terms.

No ownership rights are transferred to the customer.

12. Customer data ownership

As between you and CheckDNC, you retain your rights in the data you submit.

You grant us a limited right to host, transmit, format, compare, analyse, and otherwise process submitted data only as necessary to:

  • Provide the requested Service;
  • Produce and deliver results;
  • Maintain security and prevent abuse;
  • Provide customer support;
  • Comply with legal obligations; and
  • Enforce these Terms.

Our handling of personal data is described in the CheckDNC Privacy Policy.

13. Confidentiality and security

We use reasonable technical and organisational safeguards designed to protect submitted data.

No online service can guarantee absolute security. You are responsible for evaluating whether the Service’s safeguards are appropriate for the nature of the information you submit.

You must not submit sensitive personal data—including financial-account details, medical information, government identification numbers, or authentication credentials—unless CheckDNC expressly supports that data and its submission is lawful.

14. Service availability and changes

We aim to provide a reliable Service, but availability may be interrupted by maintenance, security events, infrastructure failures, external providers, or circumstances outside our reasonable control.

We may update, improve, replace, or discontinue individual features. Where a material change affects a paid service, we will provide reasonable notice where practicable.

15. Suspension and termination

We may restrict, suspend, or terminate an account if:

  • These Terms are violated;
  • Submitted data appears unlawfully obtained;
  • The Service is used for prohibited activity;
  • Payment is reversed, disputed, or remains unpaid;
  • Account activity creates a security or legal risk; or
  • Suspension is required by Paddle, a service provider, or a competent authority.

You may stop using the Service at any time. Ending an account does not eliminate obligations or liabilities incurred before termination.

16. Disclaimers

The Service is provided on an “as available” basis to the extent permitted by law.

CheckDNC is a technology provider and not a law firm, regulator, government registry, or legal adviser. Results must not be treated as legal advice, formal regulatory clearance, or permission to contact an individual.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Limitation of liability

To the maximum extent permitted by law, NEBS-IT SOLUTION LTD will not be liable for indirect, incidental, special, consequential, or punitive losses, including loss of profits, business, reputation, data, or anticipated savings.

Our total liability arising from the Service will not exceed the amount paid for the affected Service during the 12 months preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded, including liability for fraud or fraudulent misrepresentation.

18. Indemnification

To the extent permitted by law, you agree to indemnify NEBS-IT SOLUTION LTD against third-party claims, penalties, losses, and reasonable costs arising from:

  • Data you submitted without lawful authority;
  • Your unlawful communication or marketing activity;
  • Your violation of privacy, telecommunications, or consumer-protection laws;
  • Your misuse of screening results; or
  • Your material breach of these Terms.

19. Governing law

These Terms are governed by the laws of England and Wales, without limiting any mandatory rights a customer may have under the laws of another applicable jurisdiction.

The courts of England and Wales will have jurisdiction, except where applicable law requires otherwise.

20. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security requirements, or business practices.

The updated version will be posted on this page with a revised “Last updated” date. Material changes will be communicated where required by law.
